Enel Press Note on the Italian Antitrust Authority’s decision

Rome, January 9th, 2019 - With regards to the Italian Antitrust Authority’s decision against Enel Group companies about an alleged abuse of dominant position in the energy market, Enel reaffirms the company has always fully complied with regulations in force and is confident it can demonstrate its fairness of conduct before the Regional Administrative Court (Tribunale Amministrativo Regionale, TAR) to which it will immediately appeal.

In Enel’s view, the Authority did not take into account the thorough economic analyses and data provided by the Group, which demonstrate beyond any doubt that Enel did not interfere with clients’ decision to stay in the “regulated market” or move to the “free market”.

The end of the regulated market, set by Italy’s lawmakers as of July 1st 2020, is a major step for the electricity sector. Enel wants to be a part of this process, fully respecting competition dynamics and the needs of customers, as well as their expectation of fair data treatment, living requirements, and quality standards.

Enel stressed to the Authority that the real market distortions, which are being boosted in this current transitional phase, are mostly related to the undue availability of personal data and their illegal use by third parties. Enel has long been fighting against such activities and unfair commercial practices, promptly informing the Judicial Authority about all the cases it is made aware of, which are constantly increasing in number.

For these reasons, Enel Group companies will continue to defend the fairness of their conduct in all relevant fora, trusting in more in-depth analyses by the appointed judges.
